Mandatory Recordings for ALL Medicare Advantage/Medicare PDP Calls

Beginning October 01, 2022 Medicare brokers/agents will be required by CMS (Centers for Medicare & Medicaid Services) to record ALL ingoing and outgoing phone calls (or Zoom, etc calls) under the following circumstances:

  • Calling medicare sales leads
  • Scheduling appointments
  • Collecting Scope of Appointments
  • Collecting medication and pharmacy information
  • Discussions about your providers
  • Telephonic (and web based) enrollments
  • If a client advises that they do not wish to be recorded the broker/agent is required to terminate the call
  • Any calls or web based meetings having anything to do with Medicare Advantage and Medicare Prescription Drug Plans

Further, brokers and agents must make the following announcement within the first 60 seconds of a phone or web based  call and through email, online chat, or other means of electronic communication and prominently display on websites and all marketing materials:

“We do not offer every plan available in your area. Any information we provide is limited to those plans we do offer in your area. Please contact Medicare.gov or 1-800-MEDICARE to get information on all of your options.”
